Declaration

  1. In accepting these terms and conditions, I declare that the information on my application is correct and I understand that if the answers are untrue, my application may be rejected or my results withheld. I have read the relevant extracts from the assessment regulations, and I will be eligible to sit the exam for which I have applied, and I agree to comply with the assessment regulations, and the exam applications terms and conditions. I understand that receipt of the application form by ICAEW is not a confirmation of eligibility.

Application submission

  1. Exam applications must have been submitted by 17:00 (UK-time) on the closing date for each examination session. ICAEW cannot make allowance for any special circumstance, errors or omissions by applicants or persons acting on their behalf.

    Receipt of the exam application will be acknowledged by email and can be checked via exams online and selecting‘ check your application status’ online function. Students may also check receipt of their application by telephoning the student support line, +44 (0)1908 248 250.

Disclaimer

Please read all the following terms (‘this Disclaimer’) carefully as these set out ICAEW’s potential and total liability to you in respect of the administration and/or taking of any ICAEW exam(s).

Exam scheduling and publication of results

  1. ICAEW will use reasonable endeavours to meet its published timetables for the holding of examinations and the publication of results, but will not be liable to you for any loss arising from your reliance on these dates if they are not met, for whatever reason.

    ICAEW will similarly aim to update and communicate to candidates any rescheduled dates as promptly as possible so that you may make alternative arrangements as appropriate. However, ICAEW makes no guarantees as to when these dates might be and will not be liable in respect of any losses or issues deriving from scheduling constraints or other availability.

Difficulties or disruption – exam centre

Where you book or take any ICAEW examination at an exam centre:

  1. ICAEW will not be liable for any issues affecting you, including but not limited to: illness, anxiety, transport delays, other lateness, loss of materials or other factors which are substantially in your control and/or not within the control of ICAEW;
  2. Where an examination is suspended or cancelled, for example due to flood, fire, explosion, pandemic issues, evacuation, failure of invigilation, utilities or technical problems, connection problems, software or hardware failure, strikes, industrial action or lockouts, cyber attack or unauthorised publication of exam content, then the examination will be postponed to a later date at the same centre, or another centre in the same region accessible to you, at no further charge.

    Where the reason for the suspension or cancellation was within the reasonable control of ICAEW, ICAEW may, in its absolute discretion, pay to you any additionally-incurred travel expenses, standard class only and subject to proof of purchase, and an ex-gratia payment of up to £75. For the avoidance of doubt, ICAEW will not cover any additional accommodation or other living expenses.
  3. If you have any software or other issues during the course of an examination then you must raise the issue by informing an invigilator at the time. ICAEW or its centre representative will seek to resolve the issue at the time and may elect to give you additional time to complete the examination; if so, such additional time allowance granted shall be ICAEW’s complete liability in respect of that issue. If you do not raise the issue during the exam itself ICAEW will not later take the potential issue into account in any way.
  4. ICAEW will not be liable for any environmental issues during an examination such as noise, the behaviour of other candidates, temperature, smell, seating arrangements, facilities at the exam centre, lighting or desk space. If these concern you at the time, ICAEW may nevertheless choose to seek to assist and resolve the issue but you are advised to apply for special consideration if the issue could not be resolved at the time.

Difficulties or disruption – remotely invigilated examination

Where you book or take any examination to be taken remotely at a location not supplied or administered by ICAEW:

  1. Where the eamination is suspended or cancelled, for example due to invigilation issues, cyber attack or unauthorised prior publication of exam content, then the exam will be postponed to a later date at no further charge. Where the reason for the suspension or cancellation was within the reasonable control of ICAEW, ICAEW may, in its absolute discretion, pay to you an ex-gratia payment of up to £75. For the avoidance of doubt, ICAEW will not cover any other expenses.
  2. ICAEW will not be liable for any issues caused at any premises where you elect to undertake the examination for any reason including but not limited to those due to noise, utilities failure, internet or power outages, technical difficulties or delays, hardware problems, accidents, or any issue arising from your systems failing to meet ICAEW’s recommended requirements. It is your responsibility to ensure, ahead of the examination, that the settings and equipment you use for the examination are fit for purpose and conform to ICAEW’s recommended technical and systems requirements.
  3. ICAEW relies on invigilation software for conducting certain remote examinations. Where such software, a supervisor, or ICAEW disqualifies an examination attempt due to a breach of the rules governing the examination, such decision is final and binding. In extreme circumstances ICAEW will consider permitting you, exceptionally, to retake the examination at no additional charge. However, this will only be permitted where ICAEW agrees there has been a fault within the software, or a failure by ICAEW and will in any case only be granted at ICAEW’s absolute discretion.
  4. If you have any software or other issues during the course of an examination then you should raise the issue using the Proctor exam support. ICAEW will seek to resolve the issue at the time and may elect to give you additional time to complete the examination; if so, such additional time allowance granted shall be ICAEW’s complete liability in respect of that issue. If you do not raise the issue during the exam itself ICAEW will not later take the potential issue into account in any way.
  5. ICAEW will not be liable for any issues of which it is not notified during the examination unless this is caused by a technical failure of the Proctor exam support, for which ICAEW is responsible. ICAEW will seek to resolve reported issues and you are advised to apply for special consideration if the issue could not be resolved.

Resits

  1. Where you have taken an examination and passed it, no resits will be offered.

Special arrangements and appeals

  1. Please be aware of, and consider carefully in advance, ICAEW’s Access arrangements guidance for exams. ICAEW will not be liable for any issues which arise from your failure to notify ICAEW of required reasonable adjustments in line with this policy.

    Where such prior notification has been given and it is agreed that alternative arrangements should have been put in place but were not, ICAEW will permit a retake.
  2. Issues which fall under the scope of the Equality Act 2010 will be considered on a case by case basis and ICAEW may elect to provide alternative options if so required by the Act.

Exam disruption appeal

  1. Where you have notified ICAEW of an issue during an examination and the exam disruption appeal policy, it will be dealt with as outlined in the exam disruption appeal policy.

Exclusion of liability

  1. ICAEW’s total liability to you, in contract and tort, arising out of or in connection with: this Disclaimer; the terms and condition under which you book or take any ICAEW examination; or in connection with your booking or taking any examination, shall, otherwise than set out above, be limited to those losses which are reasonably foreseeable as a result of ICAEW’s failure to use reasonable care and skill and shall be capped at £1,000. Loss or damage is foreseeable if it is obvious that it will happen or was notified to ICAEW by you, for example in correspondence. All other losses, subject only to section 19) below, above that figure, are excluded.
  2. Subject to 19) below, you further agree that, notwithstanding any other provision herein, ICAEW will not be liable to you, in contract, tort (including, without limitation, negligence), or for pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with your booking or taking any examination for:
  • any economic losses (including but not limited to loss of salary, revenues, profits, contracts, business or anticipated savings);
  • any loss of opportunity (such as work promotions, or usage of holiday allowance);
  • any loss of goodwill or reputational damage; 
  • any distress or anxiety suffered;
  • any loss resulting from or relating to any delay in qualification; or
  • any special, indirect or consequential losses.
  1. Nothing in this Disclaimer excludes or limits ICAEW’s liability to you where it would be unlawful to do so (including but not limited to ICAEW’s liability for death or personal injury resulting from ICAEW’s negligence (or that of its servants, agents or employees), fraud, fraudulent misrepresentation or for breach of terms required by legislation which cannot be excluded).
  2. Each numbered or bullet-point provision of this Disclaimer shall be construed separately. If any part is held to be invalid, ineffective or unenforceable but would be valid if it or some part were deleted, such provision shall apply with the minimum necessary modification as to make it valid, effective and enforceable.

  1. Incorrect selection of exams by a candidate requiring a change can be amended online up to the closing date.

  1. Incorrect selection of an exam delivery method (ie, exam centre or remote invigilation) by a candidate requiring a change can be amended online up to the closing date.

Payment

Failure to make payment may lead to an applicants results being withheld.

Results Notification

The examination results are correct at the time of leaving ICAEW, which accepts no responsibility for errors or omissions caused as a result of their transmission via the internet, email, SMS or the downloading or printing by the user.

ICAEW is not responsible for your phone operator's network, third party communications networks or the internet, including the speed at which the messages are delivered. Please be aware that you may also fail to receive messages or access the service if your phone is turned off, or is not in range of a good signal, if the battery is low, the memory is full or the phone is not working. We cannot therefore guarantee receipt of messages and will not be liable for any failure of or delay in a message or content reaching your phone or email inbox.
