Can all ICAEW probate firms administer oaths?
All ICAEW probate firms are authorised to administer oaths. However, not all of our probate firms may choose to offer this service. Ask your firm or look out for the ICAEW logo which will confirm whether the firm offers both services of probate and the administration of oaths.
What kinds of services are included in the administration of oaths?
Oaths or (non-religious) affirmations are typically taken before the authorised person - the Commissioner for Oaths who can administer an oath or affirmation, sign a statutory declaration and help you to swear an affidavit. An affidavit is a written statement of facts that is sworn or affirmed. For example, to verify a name change. A statutory declaration is a formal written statement declaring that something is true.
How do I find a firm to help me with oaths or similar services such as swearing an affidavit?
ICAEW firms who are accredited for probate and oaths can be found by searching ICAEW’s online register. Firms will also have an ICAEW accredited logo on their website confirming whether they offer just probate services, or probate and the administration of oaths.
