New inquiry: Government considers new employment laws to protect and support menopausal workers

Employers should monitor outcomes of a government inquiry ‘Menopause and the workplace’, which could lead to changes in the law to give menopausal workers, including those who do not identify as women, greater protection, support and employment rights.

The inquiry’s questions are based on recent reports that the menopause adversely affects three out of five women in work, and approaching 900,000 have resigned because of it.

Currently, menopausal workers are protected if they can show discrimination on grounds of their age or sex, or if they are disabled, but the inquiry asks whether the law should be changed to protect them specifically on grounds they are menopausal, and in what way.

It therefore asks whether menopausal workers are discriminated against, how much, and what sort of discrimination they suffer, and whether employers should be obliged offer guidance, advice, adjustments and other support.

  • Employers should monitor the inquiry’s progress and outcomes, consider their impact, and review their policies, procedures and practices to identify changes that may need to be made.
