The EHRC has issued guidance ‘Coronavirus (COVID-19) guidance for employers’ on equality and discrimination issues during the coronavirus pandemic, to help employers avoid inadvertently breaching anti-discrimination laws.

An employer making a one-off decision or carrying out an act which disadvantages a disabled employee may not be indirectly discriminating against the employee, because their decision or act may not be a ‘provision, criterion or practice’ - provided it is genuinely one-off – a recent legal ruling confirms.

Employers should consider what adjustments to make to sickness and other policies to reduce disadvantages to disabled employees, and avoid withdrawing reasonable adjustments already made - unless a change in circumstances justifies them doing so or they implement more effective adjustments - or risk claims for unfair dismissal.

Discrimination
These ten sections of the chapter on employment cover discrimination - the Equality Act 2010 replaced all previous discrimination legislation. Discrimination on the basis of: age; disability; gender reassignment; marriage and civil partnership; pregnancy and maternity; race; religion and belief; sex; and sexual orientation is outlawed. In addition discrimination against people with criminal records, part-time workers, fixed-term workers and agency workers is also covered.
