New law: Businesses making white goods, electric cars and other energy products face new eco-design and labelling rules

Businesses making consumer products such as energy white goods and electric cars in the UK face new laws such as a legal right to repair, more stringent energy efficiency requirements and new energy labelling from summer 2021, subject to a (yet to be confirmed) transitional period.

The new rules include the following:

  • Right to repair rules saying that manufacturers of relevant products must provide consumers with information about how to maintain them, and access to spare parts so they can be repaired rather than having to be replaced.
  • For some electric products, setting higher energy efficiency standards.
  • To reduce confusion, changing efficiency ratings displayed on product labelling to a new A to G scale (abolishing the old A+, A++ or A+++ ratings).

The proposed new rules are set out in the Department for Business, Energy and Industrial Strategy (BEIS) response to a recent consultation. The proposals mirror equivalent EU rules, to avoid creating further barriers for manufacturers.

Recommendation

  • Manufacturers should consider the proposed new rules in the BEIS response and plan how to adapt their processes, buying, budgeting, supply chains, etc to comply with them.
