New guidance: UK businesses involved in supplying products into the EU consider impact of ‘significant’ updates to EU Blue Guide

Businesses involved in the supply of products into the European Union are reviewing their products, paperwork and procedures following substantial updates to the European Commission’s ‘Blue Guide’ guidance on the EU’s product rules.

The guidance ‘Commission notice: The ‘Blue Guide’ on the implementation of EU product rules 2022 (Text with EEA relevance) 2022/C 247/01’ is not legally binding but is key to interpreting and understanding EU product rules. It applies mainly to CE-marked goods such as machinery; gas appliances; recreational craft; electrical, electronic and radio equipment; medical equipment and PPE; toys; pressure equipment; and drones.

The updates are driven in part by changes in technology since the last edition, changed routes to market for relevant products (including online trade), and changes in EU approaches to regulation of software updates, health and safety as it applies to the new ‘right to repair’ for pre-existing products, and what ‘placing on the market’ means under some EU product laws.
