New guidance: ICO new guidance on marketing by electronic mail and phone

Organisations marketing by electronic mail and/or live phone calls will welcome new Information Commissioner's Office (ICO) guidances on direct marketing by these means.

Electronic mail includes emails, texts, picture, video and voicemail messages, social media communications and in-App messages. Live phone calls means calls that are not automated.

The new, free guidances ‘Guidance on direct marketing using electronic mail’ and ‘Guidance on direct marketing using live calls’ give a detailed account of relevant direct marketing rules and restrictions, supplemented by examples of the rules in practice.

They are designed to be read in conjunction with existing ‘Guide to the Privacy and Electronic Communications Regulations 2003’ and the yet-to-be-finalised ‘Direct Marketing Code of Practice’.
