Take note of the latest disciplinary cases to ensure you or your firm are not making similar mistakes.
Since the last update, eight Tribunal Committee tribunal orders, twelve consent orders from the Conduct Committee and five settlement orders have been published.
Included within the latest published orders are the following:
- Submitting an ACA case study mock exam for assessment which plagiarised the work of a colleague, contrary to subsection R111.1 of ICAEW’s Code of Ethics – Integrity (effective 1 January 2020).
- Failing to comply with regulation 21 of the Clients’ Money Regulations (effective from 1 January 2017) due to failing to ensure that the sum of the credit balance held for all clients was at least equal to the total balance held in all client bank accounts; and/or, withdrawing amounts from client bank accounts that were greater than the credit balance held for that client.
- Preparing accounts incorrectly for 17 accounting periods due to no amortisation charged on goodwill, contrary to paragraphs 6.13 to 6.16 of the Financial Reporting Standard for Smaller Entities (effective January 2005), and/or paragraphs 6.13 to 6.16 of the Financial Reporting Standard for Smaller Entities (effective April 2008), and/or paragraph 19.23(a) of FRS 102.
- Preparing and certifying service charge accounts for a client for four accounting periods which misstated the amount of monies held as cash at bank and on trust.
