Legal Services Regulations effective from 1 June 2023 (these replace the previous Probate Regulations).
Firms accredited for probate by ICAEW are required to comply with these regulations which include the Probate Compensation Scheme Regulations

ICAEW established a Probate Compensation Scheme to accord with the requirements of the Legal Services Act 2007. These regulations are being replaced with the Legal Services Compensation Scheme Regulations. The regulations are being updated with small, consequential changes to align terminology with ICAEW's updated disciplinary framework which came into effect on 1 June 2023. Please continue to refer to the Probate Compensation Scheme Regulations effective 23 February 2017 until the updated version is published.
ICAEW works collaboratively with other regulators of legal services where their members practise within ICAEW licensed firms and vice versa. The protocols for enforcement procedures between the bodies are set out in a Memorandum of Understanding effective June 2017 and updated from March 2019 for GDPR and the addition of ACCA.
The Probate Regulations were replaced by the Legal Services Regulations on 1 June 2023. Small changes were made to align terminology with ICAEW's updated Disciplinary Bye-laws and regulations. (Examples of changes include committee name changes and references to specific Disciplinary Bye-laws).
