Here is a step-by-step guide on what to expect when engaging an ICAEW-accredited Commissioner for Oaths.

Step 1 Find an ICAEW accredited firm that offers administration of oaths

Use ICAEW’s online register to find a firm accredited for probate and the administration of oaths. Some firms may have chosen not to offer oaths services for example due to their location. If you are not sure, contact the firm you wish to use, or check their website to confirm whether they offer both oaths and probate services. Look out for the ICAEW-accredited logo to help you easily identify firms offering oaths administration.

Step 2 Contact the firm and book an appointment

When contacting the firm let them know:

  • The type of document which needs to be sworn or declared. 
  • The number of exhibits you are attaching
  • Any access needs or reasonable adjustments you require.

This enables them to prepare for your visit and offer a quote. The firm may explain what identification you need to bring, such as a passport or driving license photocard. In some cases, the firm may ask you to email your document in advance.

Step 3 Prepare your documents

  • Make sure your documents and any exhibits are ready
  • Don’t sign anything yet, you must sign in front of the Commissioner for Oaths.

Step 4 During the appointment

  • They will check your identity
  • You will declare/swear/affirm in front of the Commissioner.
  • The Commissioner will witness, sign, and confirm the place and the date it is made.
  • You will pay a fee. The fee is set by law and it is:
  • £5 for each oath, affidavit, or declaration
  • £2 for each document (called an exhibit) attached.

Step 6 After your appointment

  • Keep a copy for your records.
  • If a submission deadline applies, send it promptly as instructed.
