New guidance: New guidance for employers dealing with COVID-related issues, including employees who refuse vaccinations

Employers will welcome new guidance from Acas, the government, and the Information Commissioner’s Office (ICO) to help them handle employment law and data protection issues arising from the COVID-19 pandemic, including how to deal with employees who do not want to get vaccinated.

Acas, the independent public body that provides free, impartial advice to employers, employees, and their representatives, has published guidance ‘ Working safely during coronavirus’, including how to deal with workers who do not want to be vaccinated against COVID-19.

The government has issued ‘Guidance: Coronavirus (COVID-19) testing: guidance for employers and third-party healthcare providers’ which is for both employers and also healthcare providers.

The ICO has issued guidance ‘Data protection and coronavirus – advice for organisations’, which includes a section on testing, as well as covering:

  • Regulatory approach
  • Surveillance
  • Case studies: disclosing information for contact tracing
  • Maintaining records of staff, customers and visitors for contact tracing purposes
  • Vaccinations

The Health and Safety Executive also has a web page giving COVID-related guidance and information, including topics such as protecting home workers and drivers’ welfare.
